Federal Judge Rules Planned Parenthood Lawsuit Challenging Missouri Pro-life Regulations May Proceed

In a ruling late last week, Federal District Court Judge Howard Sachs in Kansas City ruled that Planned Parenthood’s lawsuit challenging Missouri laws requiring doctors who perform abortions to have clinical privileges at a nearby hospital, and laws requiring abortion clinics to be regulated as ambulatory surgical centers can proceed. The lawsuit was brought after the U.S. Supreme Court ruled last summer in a case from Texas that some abortion clinic regulations unconstitutionally bar access to abortion for women by imposing requirements that evidence shows does not benefit women’s health.

Judge Sachs ruled that it was not necessary for clinics operated by Planned Parenthood in Columbia and Kansas City to request waivers of clinic regulations from state officials before being permitted to seek relief in court.
