Judge Howard Sachs, a federal trial court judge in Kansas City, ruled in favor of Planned Parenthood this week in their challenge to Missouri abortion laws. The judge entered a preliminary injunction, prohibiting enforcement of Missouri laws requiring abortion doctors to have clinical privileges at a nearby hospital, and requiring abortion clinics to meet the structural and safety requirements of ambulatory surgical centers.
The court’s ruling follows very closely to the reasoning of the U.S. Supreme Court last summer, in a ruling that struck down similar laws in Texas. In that case, the Supreme Court ruled that the evidence presented did not establish that the Texas laws protect women’s health sufficiently to justify the burden they imposed upon a woman’s right to choose. Attorney General Joshua Hawley has promised to appeal the ruling the Eighth Circuit Court of Appeals.
