On Monday, a Cole County Judge rejected the Missouri Science and Innovation Reinvestment Act (MOSIRA), saying that lawmakers approved it in an unconstitutional way last fall.

Circuit Judge Dan Green’s ruling eliminates MOSIRA because lawmakers passed it with a contingency clause, which said it would only take effect if lawmakers also passed a broader tax credit reform bill. The tax credit reform bill failed. Gov. Nixon had hoped to set aside $4 million for science and technology startups through MOSIRA.

Attorney General Chris Koster has indicated he will appeal the decision. Proponents of MOSIRA are expected to await the results of the appeal before taking any further action in the general assembly.
