Pending Execution Case Had no Federal Review

If a state is to carry out the death penalty, all assurances should be made that the inmate’s due process rights are protected. Inmates that receive a death sentence are entitled to a federal review of their case to ensure that errors in the trial are not missed. Mark Christeson is scheduled for execution on October 29, but there has been no federal review of his case. Christeson’s appointed federal counsel filed his habeas petition four months past the deadline, the court dismissed the petition and Christeson will not receive this important review of his case.  The fact that Mr. Christeson has not received a federal review of his case is a miscarriage of justice and undermines the credibility of the death penalty system.
