Texas Federal Court Blocks HHS Transgender Services Mandate

Just prior to the date of its implementation, a Texas federal District Court granted a nationwide injunction preventing enforcement of an HHS regulation prohibiting discrimination by healthcare providers on the basis of “gender identity.”

The regulation, which applied to any healthcare provider that receives federal funding (read ‘all’), would have required even religiously-affiliated hospitals and physicians to provide gender transition services under certain circumstances to patients who requested them.

Judge Reed O’Connor ruled that the regulation violated the Administrative Procedures Act by “contradicting existing law and exceeding statutory authority.” The order will protect those healthcare providers that consider providing gender transition services to be contrary to the well-being and best interests of patients struggling with gender dysphoria.
