U.S. Supreme Court Issues Order Giving Hope to Little Sisters of the Poor

This week, the U.S. Supreme court issued an order asking the parties in the contraceptive mandate case involving the Little Sisters of the Poor to suggest other methods by which women employees could obtain contraceptive coverage through their employer’s health plans without offending religious convictions.

Court observers noted during oral arguments last week that the court appears evenly split on the case since the death of Justice Antonin Scalia. The order asking for additional briefing is unusual and suggests that the court may be looking for a way to resolve the issue without resorting to a re-hearing after the appointment of a ninth justice to replace Scalia.
